• "MyWorkingDay" refers to the service provided by MyWorkingDay Ltd, including all related websites, applications, and services.
• "User" means any individual or entity who accesses or uses the Service.
• "Account" means a registered account to access certain features of the Service.

Use of the Service

• You must be at least 18 years old or have the legal capacity to enter into a contract in your jurisdiction to use MyWorkingDay.
• You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
• You are responsible for safeguarding your password and for all activities that occur under your account.
• You agree not to use the Service for any unlawful or prohibited purpose.

Service Access and Payments

• MyWorkingDay provides employee feedback management services including mobile feedback collection, analytics, and reporting features.
• Service access is provided on a subscription basis as agreed upon during the account setup process.
• Subscription fees are billed in advance and are non-refundable except as required by law or as otherwise stated in these Terms.
• You may cancel your subscription at any time; however, you will not receive a refund for any unused portion of the subscription period.
• Payments are processed securely by Stripe. MyWorkingDay does not store your payment card details.

User Content

• You retain ownership of any content, data, or materials you upload or input into the Service ("User Content").
• You grant MyWorkingDay a non-exclusive, royalty-free, worldwide license to use, host, store, reproduce, modify, and display your User Content solely for the purpose of operating and improving the Service.
• You are solely responsible for your User Content and the consequences of posting or publishing it.

Data Protection and Privacy

MyWorkingDay respects your privacy and is committed to protecting your personal data. Please refer to our Privacy Policy for information on how we collect, use, and protect your data.

Intellectual Property

• All content and materials on the Service, including but not limited to text, graphics, logos, icons, images, and software, are the property of MyWorkingDay Ltd or its licensors and are protected by intellectual property laws.
• You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions, or you have our written permission.

Prohibited Conduct

You agree not to misuse the Service or help anyone else do so. For example, you must not:

• • Access or use the Service in any manner that could damage, disable, overburden, or impair any MyWorkingDay server or networks.
• • Attempt to gain unauthorized access to any part of the Service or related systems or networks.
• • Use any automated means to access the Service for any purpose without our express written permission.
• • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
• • Violate any applicable laws or regulations.

Termination

• We reserve the right to suspend or terminate your access to the Service at any time, without notice or liability, for any reason, including if you violate these Terms.

• The Service is provided on an "as is" and "as available" basis. MyWorkingDay makes no warranties, express or implied, regarding the Service, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
• MyWorkingDay does not warrant that the Service will be uninterrupted, secure, or error-free.
• To the maximum extent permitted by law, MyWorkingDay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; or (d) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Service by any third party.
